This case was filed in U.S. District Court for Northern California in 2005. This case is a member case of the FedEx Ground/Home Multi-District Litigation case. The multi-district litigation (MDL) is the consolidated case of the group of lawsuits alleging wrongful classification at FedEx Ground and Home Delivery. The January 2006 amended complaint includes the federal charges for the MDL.
Following the California ultimatum of Sept. 20, 2007 - the mass firing of all single-vehicle contractors in California - the lawyers for the plaintiffs in the state class action case (Estrada) and the sister national case (Alexander) on Oct. 1 petitioned the MDL judge for a temporary restraining order to block the terminations. The company responded to the restraining order motion on Oct. 5. Judge Miller denied the temporary restraining order motion by the drivers on Oct. 12 (the order was released through PACER on Oct. 15).
