This is the consolidated case of the group of lawsuits alleging wrongful classification at FedEx Ground and Home Delivery. The various lawsuits were consolidated into this multi-district litigation (MDL) case at the U.S. District Court for Northern Indiana in August 2005. The plaintiffs are seeking national class certification for charges based on denial of employee rights under the Family Medical Leave Act (FMLA) and the Employee Retirement Income Security Act (ERISA).
In October 2007, Judge Miller certified the first claims including the Federal ERISA claims as a class action. FedEx asked the U.S. Appeals Court 7th Circuit to review Judge Miller's certification order. In January 2008, the three judge panel from the 7th Circuit unanimously rejected FedEx's request for review. In March 2008, Judge Miller further certified class action claims for another 19 states but denied certification in 9 states.
